There are certain shows which make an effort to not use any material which fits the DMCA non-retention policy. Would it be difficult to add an option to the "program edit" form to always kick a particular "program" into the permanent archive?

not sure i follow? you want it to not archive the program? or not allow it to be deleted so that it'll be retained?
