Hi discipolo,

Thanks for reporting this bug.

I checked the function and I think this happens when Logo, Site Name and Site Slogan are all turned off.
This is a bug for both D6 and D7, I am releasing 6.x-1.5 and 7.x-1.9, which will be available shortly.
