When I add a term to vocabulary (admin/content/taxonomy/xxx/add/term) and I enter a name of non existing parent - the new term is created at the top level.

I think it should'n allow to do that, should display an error.

I agree with you. I'm not sure if this is still an issue in the 7.x version of the module - I will need to investigate.
