overlay theme (core module) doesn't render properly

Hi

My steps:

1 - site upgrade from 6.x to 7.0 . before disabled modules except core modules
2 - go to upgraded site 7.0
3 - go to modules > check "overlay" module, save
4 - the overlay admin theme appears
5 - chose any other admin option on the top menu
6 - overlay admin theme disappear
7 - go to modules and check if "overlay" is enabled. Yes, it is
8 - go to personal settings and check if "Use the overlay for administrative pages" is enabled. Yes, it is.
9 - clear caches
10 - disable overlay module
11 - clear caches

12 - go to modules > check "overlay" module, save
13 - the overlay admin theme appears
14 - chose any other admin option on the toolbar
15 - overlay admin theme disappear. aagain

Repeated these steps with different themes (mayo and Bartik)

Any suggestion? bug?
