Comment display settings is displayed before the added comment.

I display the "comment display settings" on every page, and the problem that I am having is that the "comment display setting" block is placed before the comment form, and when a user posts a comment the display setting block stands between the older comments, already on the page, and the new comment.
It looks bad on the page, is there a way around this?
