Panels Seems to ignore context visibility rule

hi,

I am setting up a custom content in my node template that should only appear if a file has been uploaded to the field. I add the visibility rule that the attached file content exists and the block still gets displayed on nodes that don't even have the field in their content type or have the field but do not have a file uploaded. I am not sure where the problem is occurring or if I missed something but the block should only appear when the file is uploaded.
