It is not possible to create a new book when inheritance is being forced (discard user selection) and requiring a selection. Failure is with the following message: "The parent of this book page does not have a group assigned. The parent book page must have at least one group."

If requiring a selection is disabled, all new books are created with no group and public. Need to disable the parent checks when the option to create a new book is selected AND honor the user selection for new books created.

I've given up on using books. I've moved to using OG Menu. Users create content and then are allowed to add it to a navigation menu for the OG they are tagging the content to.
