Weird positioning and confusing placement of "Add new comment"

Using a stock the Garland template, on clicking "Add new comment", a blank comment will appear for editing, however, above the blank comment, is a copy of the original post (which is good for reference) , but, just below that, is "Add new comment" again. It seems to me that "Add new comment" should not show up at all when you are in the middle of a comment post.

Similarly, during preview of a comment, a preview of the comment shows (expected), followed by the CRUD for that comment (fine, if changes need to me made), followed by the original post (again, a good reference), but then "Add new comment" shows up once again. Why should "Add new comment" appear during a comment creation and it's preview. It seems it should not be display during these two operations. See attached jpgs.
