I have installed drupal 7 number of times and after installation I got this error on the updates page:

Does anyone know how to resolve this?
Also cannot upload themes using either the drupal ftp link or downloading the files locally and then uploading.

it's not. It's typically one folder up from the root.
If you want to change the path to it, its setting is in administer -> file system

actually it doesn't NEED to go in there. Drupal's default path shouldn't need to be changed.
You have to make sure perms on the folder are correct.

Yeah I am having trouble still uploading modules, I am getting this error:

does anyone know if this is related, I am not understanding where this tmp folder needs to be? I never had to do this in the past.

what are the server level permissions on the tmp folder?
my tmp folder is in the
my tmp folder is in the /sites/default/files folder and the permissions are set to 777 which I figured lets it write to it, is that what I need?

seems you will need to chime in on http://drupal.org/node/1108870 which is an already created issue against the update.module
However, 7.x-dev should be tested and the issue moved to the 7.x-dev core if confirmed to still exist in -dev and that it hasn't already been fixed.
change your tmp file location
Check your tmp file location to ensure it is writable here (D7) admin/config/media/file-system
