I haven't confirmed that this is a real problem yet, just wanted to close an issue that was going no-where.

Letharion, I've been playing around today to figure out the specifics of an empty panel being included. Take a look at my post to see what is going on #1391450: Panels does not hide an empty mini panel

I found that when a title is included, but left blank, there is a missing closing </div>. Could be related.
