Call to a member function condition() on a non-object in function _faq_ask_list_unanswered

After updating to the latest dev-version I get the following error message when immediately after enabling the module:

Fatal error: Call to a member function condition() on a non-object in /var/www/html/cm7/sites/all/modules/faq_ask/faq_ask.module on line 1535

Checking the source code around line 1535 I couldn't find anything which looks wrong. Or can this error occur due to a context or data problem?
