Required fields

I hope you can help me once more.

I have set up the Campaign Monitor sign-up form to require a name as well as email address, but it doesn't seem to work as expected. If I don't enter any data into the form, or if I input a name and not an email address, I get the expected error message saying "email field is required" and "you were not subscribed...".

However, if I enter an email address and leave the name field blank, the error message is incorrect. It brings up two simultaneous messages: one message is red saying that the "name field is required" (which is fine), but the other message is green and says "you are now subscribed to the (............) list". I would have thought that if either field was blank then the sign-up should have failed.
