I'm finding that nice menus work with menu icons with or without this patch. What theme are you using?

I've tried this with Omega, and nice menus seem to work just fine with the default css. I'm can't apply the patch you posted, because it breaks certain things in Garland. Can you post an example of the HTML you're getting with your theme and nice menus?
