Public directory backups includes .htaccess file and in the restore process cannot replace .htaccess.

Exception: File /var/www/html/test/sites/default/files/tmp/.htaccess already exists and is write protected in Archive_Tar->_error() (line 635 of /var/www/html/test/modules/system/system.tar.inc).

You can add ".htaccess" to the list of files to exclude at admin/config/system/backup_migrate/export/advanced.

Hmm, it's a thin line between documentation or default setting - not sure, anyway, here's a patch.
