I've found that:
If I have empty lines set to h2 or h3, I'll have empty (but numbered) lines in tableofcontents too.
Think that your module should distinguish empty lines and not add to tableofcontents.

Perhaps a better solution would be to have a seperate module which filtered out empty HTML elements.

Was there a reason why you had such data?
