Override form validation when uploading the image?

If a node submit form has required fields, the uploading of a preview creates a validation error (when all field requirements have not been met).

I think this is quite irritating and probably confusing for a user. It sort of leads one to place the upload preview item at the bottom as one tends to complete a form top-down.

Any solution for this?
