With which (admin) theme is that?
I don't get that with the default (Seven) theme, and you patch even removes the icon (see before and after in attachment)

This was in seven theme overlay mode... ?!?

Seven overlay and non-overlay, doesn't make a difference for me.
Using Drupal 7.12 (from git, but pinned at 7.12 tag), no CSS aggregation, no caching enabled, almost no other contrib modules enabled (devel, libraries and geshi filter)

I try to find out what is inheriting this... maybe it's my website below the underlay... We could also use a normal drupal_set_message with type warning... not sure if it need to stay in this position.

Can't reproduce. Tested on D 7.32, with on and off aggregations, cachings and compressions. Tested branches: 7.x-1.2, 7.x-1.x-dev. UI haven't any issues on Performance page.
