Hide exposed sort creiteria if view is empty

Trying to figure out how to hide the Sort Criteria if the view doesn't show any content. Here's an example of what is happening. On my stock Ubercart demo site http://www.ubercartdemo.com on the front page the product view is still showing the Sort form even though there are no products listed. I need a way to hide the form if no content is displayed.
