Error on moderating content

I am getting the following error:
Notice: Undefined index: #access in workbench_moderation_notes_form_workbench_moderation_moderate_form_alter() (line 13 of /home/xxxxx/public_html/sites/all/modules/workbench_moderation_notes/workbench_moderation_notes.module).
Once the content has been published the error disappears, but reappears if its reverted of editing?
