warning: array_shift with twitter when no items are returned

This has been annoying me for a while, as it leaves a red item in our error logs, so decided to delve into it today, and get a fix in. It appears all that was needed was to declare the $items variable as an array, once this is done, all seems well so far. Am creating a patch now, so will attach to this ticket once I have the ticket number in case others want it.
