i've tried a few of the patches mentioned in these bug reports, but haven't found anything yet to address this problem, although others have mentioned it:

I just want one vocabulary in the menu, so I don't want its name alone to be the default menu, I want its first level terms to be the default menu.

could this be an option? sounds like maybe it used to be an option...

This is caused by the strange un-editability of the vocabulary item. You should be able to disable that item in menu admin. This will be fixed when that issue is...
