The ToS doesn't follow normal formatting, all text just runs together. Line breaks are not recognized, nor are HTML tags of any kind that I've tried. I think this should be like any other Node edit box with appropriate Input Format controls, or at least defaulting to Filtered HTML for the basic formatting.
