UL not leaving space before next paragraph

I seem to have a problem with formatting on Drupal 7 with ckeditor. When I use a list there is no paragraph space left between it and the next paragraph. I tried searching but could not find an answer.
I am attaching some images of the problem.

the source html shows as
<p>this is a test of list formatting:</p><ul><li>one</li><li>two</li><li>three</li></ul><p>this should be spaced away from the list as a new paragraph.</p><p>another paragraph.</p>
I can do a clunky fix by using shift enter for a
but any suggestions on how to resolve this would be good.
