I moved the javascript include function call from the menu hook to the theme function. It should only be called when it will actually be used, and was periodically causing a half black screen in Safari.

I saw the other post about not knowing where images will be, which is why the js is always loaded. I think it would be safe to give a setting to toggle it globally.

I am not able to reproduce this behavior without further information. No one else seems to have this issue, thus marking as 'by design'.
