http://drupal.org/node/1742438 breaks the new vertical tab support - looks like #access is required on the form elements now.

Nothing to do with #access actually - read #1742438: Vertical tabs header and container rendered even when no vertical tabs for the whole story. Fixed for our case by using #group on the fieldsets and not making them children of ['settings'].
