Cookie warning only display when overlay is active

Looks like it is only working when seven is active.

Seems the problem is only with Omega, version 3 to be precise.
When I change to a standard theme like bartik it works fine.

So something in omega is messing things up.
I tried two diff sites both has the same problem.

Also the slideshow keeps working when switching to a other theme.
