I can't replicate this bug nor can I imagine this being caused by CSS or XHTML. It's most likely a javascript issue, not related to the theme itself.
Have you tested this with other themes and could you give a list of enabled modules?

Are you positive this only happens with deco and not any other theme? Deco doesn't use any javascript so I would be really surprised if the theme is causing this.
