Weight Field Revealed on table drag tables when form.inc validation fails because of required field

If you select files to upload, at least one, then proceed to save and you didn't place anything in the node title field, the form reloads requesting that you give the node a title. But when this even occurs, attach files drag table now shows the weight field in addition to the drag handlers. I should mention that even with the weight select field visible the handlers still behave as desired. Also, a minor issue, the fieldset collapses on reload though there are files to upload but that might not really be considered a bug. I've attached a screen shot of the undesired behavior but with the field set expanded (its not expanded after reload because of the above mentioned bug/potential bug). This is of course on a fresh checkout of D6 HEAD.
