This is a ripoff from the design "Delicious Fruit" by Dieter Schneider which is _NOT_ GPL.... and uploading non-GPL themes to drupal.org is one thing but to add "Theme Designed by CMS Website Services, LLC" to your footer is just shameful and a great way to associate fraudulent practice with your company.

Just wanted to mention that I got an email from CMS Website Services and it was a misunderstanding between them and their designer. So while the OP is correct that the theme needed to be removed, the post was more inflamatory than it needed to be. It's a good idea to keep posts reporting license issues neutral and just report the facts rather than making accusations until the facts are known.

(I had to switch the project... Since the project is gone, trying to follow up to this issue errors)

Dieter Schneider who is the original designer emailed me regarding both the Blossom theme (Delicious Fruit) and the Purple Beauty theme and gave permission for both themes to stay listed on the site as long as a link to his site was put in the footer. I explained to him that people could freely remove it since it would be GPL and he wrote back again that it was fine. We will update the Blossom theme by Monday with his link as he requested and I also emailed the maintainer of the Purple Beauty theme and explained the situation to him.

If any further action is required on my part please let me know, otherwise I assume that the issue is resolved.
