According to the openwebdesign archive the themes' license is CCPL. Drupal.org only hosts GPL v2 code. Did you get the theme author to relicense the theme under the GPL v2?

I did get the authors permission to GPL the theme and put it on Drupal.org. He only said to leave the link to his site in the footer. He understood that anyone that took the theme and did whatever they wanted with it would more than likely remove the footer, but I think he assumed that the lazy ones would just leave it there.

I don't have the original correspondence between us simply because I didn't think I needed to provide proof of permission. I've tried to contact the author but his email address no longer works. I think the domain has been sold to someone else and the contents of the site has been changed. This in fact is another issue in the queue for this project.
