I created a new product type under the configuration called "Subscription" it is inbetween shippable and generic. When I go to create the product I do not see the option to have type Subscription

Have you edited the Product Node?

Administer -> Content Management -> Content Types -> Product -> Edit

Down at the bottom will be a number of check boxes for product types, find your new one and check it.
