I really go crazy on this issue.

I'm using nginx server now, and the attachment upload is not working for ajax upload method (hit the attach button under the field) but work for submit the whole content.

It'll fix this problem when I close Clean URL, so I think this might also be the problem of 'drupal_add_basepath'?

the other question is some of the URLs can't be reached by using the same rewrite rules as in Apache, it just give me 404 error(e.g. logout link). I think this might be the same reason as above.

I'll be appreciate if anyone can post a patch or a way to work out.

Considering the time elapsed between now and the last comment plus the fact that D5 is no longer supported, I am closing this ticket.
