Can't check "public" checkbox

Hi guys,
I have a problem that's been around a while but I think it's gotten even more nasty with my recent upgrade to OG 5.x-6.1
Whenever I select a group in the select list (as opposed to the checkboxes) I can't check the "public" checkbox.
Sometimes, I can check another checkbox, then check the public checkbox, then uncheck the other checkbox ... as one workaround.

I am having the same issue. I think it is something to do with the jquery OG uses not liking the new structure of the select list. I'll post back here if I figure it out.
EDIT: No luck so far, but I did try removing the extra fieldsets that are added and it didn't help, if anyone else is working on this.
