Description
if a publication has an attachment, and this attachment is selected to be not listed, it is not listed in the tabular view (which is fine), but it is listed in the list-view.

When you say "and this attachment is selected to be not listed", do you mean on the permissions page (admin/user/permissions) you have un-selected "show download links"? I tried this here and it seems to have the desired effect. You can't turn it off for the admin (uid=1) user though.

Ermh... Neither, I guess.
When you consider this publication:
http://thomas.deselaers.de/node/529
it has 3 attachments. Two of them are checked to be listed on the "edit" page of this node, the third one is unchecked, and thus it is not listed on this url.
However, when you consider the page
http://thomas.deselaers.de/publications
And look for this publications (nearly the last for 2008), you will see three attachments listed.
