Anyway to make it so it positions above the site layout ? I was thinking it might since the code is after the body tag but apparently the CSS is over lapping the top of the layout

That's exactly the point. If you don't want this behaviour you'd have to change the CSS yourself. Creating some CSS for the behaviour you'd like to see is very hard to make cross-template as the bar would easily interfere with other elements positioned absolutely.
