Comment View control panel is always displayed on top of forum node

The control panel for customizing the way that comments are displayed always stays above the original forum post, unless you completely turn off this option for the entire site in admin/comment/configure

If you select the option for having the control panel appear both above and below the comments, you instead get two control panels, both above the original post.

The control panel should appear below the first post and/or below the last comment, depending on your settings for the comment module.

The control panel for comment moderation has the exact same problem.

I guess the problem lays somewhere on the choice of tabled layout in node-forum.tpl.php (or perhaps the override functions in template.php?).
