This issue has been reported earlier for Drupal version-5.

I think there are also reports in v-6, v-7 (http://drupal.org/node/283045). I tried to apply the patch from http://drupal.org/node/114745 which as actually referring to v-6.3.

Applying this patch on v-5.10 does not work and the top-level module still remains.

Drupal 5 is no longer supported, and this issue is being addressed for Drupal 6-8 in #283045: Allow top-level pages to be removed from books
