links only work in clean URLs - cvs, drupal 4.6.3

in a previous post it was stated that the cvs was supposed to work in 4.6.x, but for me it only works when clean urls are enabled. when they're off, the links on the cc buttons and text turns out something like
http://URL-ROOT/drupal-4.6.3/?q=http://creativecommons.org/licenses/by-sa/2.5/
