Duplicate content issue with comments links

Comment links on posts with no comments look something like this:-

comment/reply/17#comment-form

If there are already some comments then it takes the form:-

content/title#comments

So while the post has no comments we have a situation that we are linking to identical content using two distinctly different URLs. I.e.

content/title == comment/reply/17

Is there a way to alter the comment link to ALWAYS be:-

content/title#comments

regardless of whether comments exist already or not?

Is there something I'm missing here?
