It is located in tinymce/jscripts/tiny_mce/plugins/spellchecker, just use an IF statement to detect if the plugin is available there...

I'm reluctant to add further conditions to the code until there is a better internal editor plugin handling in place. Hence, marking as duplicate of #328252: Handle compatibility of internal plugins via plugin API
