I've the following questions regarding the GPL compatability of the theme.

  • Was the original Wordpress theme licensed under the GPL?
  • If not, do you have permission from the original author (or are you the original author) of the Wordpress theme, to license the theme under the GPL?
  • Who owns the copyright on the "lich king" image / art and can it be released as GPL?

The other question regards a link in page.tpl.php

Why is the link <a href="http://www.randyrun.com">WoW Gold</a> Reseller in page.tpl.php?

These questions also apply to your WoW Night Elf project.

hi there,
I have the permission from the orginal author "Nuno M. Buljubasic" at nunodesign.de. The orginal themes can be found here: http://www.homepage-designer.info/wow-templates.html

The WoW Gold reseller link is inserted because they support nunodesign with servers. But I can ask if I can remove the link if necessary.

I am not sure with the copyright. Maybe I should add this code to the footer:

World of Warcraft® and Blizzard Entertainment® are all trademarks or registered trademarks of Blizzard Entertainment in the United States and/or other countries. These terms and all related materials, logos, and images are copyright © Blizzard Entertainment. This site is in no way associated with or endorsed by Blizzard Entertainment®.

Thank you for the reply. If Nuno Buljubasic holds the copyright on the Lich king images, or when they are released in 1) the public domain 2) under the GPL, then they can remain in the Drupal.org CVS repository.

The Drupal.org CVS repository cannot hold items which are copyrighted by a party, but not released under the GPL.

I have added a theme_license.txt file and the permission of the orginal author.

Thank you. Is images/lichking.jpg copyrighted by Blizzard? If I read the theme_license.txt correctly, it appears not.

Blizzard says that all peple can use their images, screenshots etc. in their non-commercial projects. The orginal author says, that the images come from Blizzard and therefore they are copyrightes but free for use in private sites.

The legalfaq says:

What is Blizzard Entertainment's® copyright / trademark policy for the Internet, specifically for fan sites? Can I use Blizzard Entertainment's® images, text or sound on my web page? Is it ok if I use screenshots I take in-game on my web page?

Yes, within certain limits. We asked our legal department to provide some guidelines for you, and here is what they said:

Blizzard Entertainment® hereby grants you a personal, non-exclusive, non-transferable and non- assignable license to use and display, for home, noncommercial and personal use only, one copy of any material and/or software that you may download from this site, including, but not limited to, any files, codes, audio or images incorporated in or generated by the software (collectively the "Downloaded Content") provided, however, that you must include or maintain all copyright and other notices contained or associated with such Downloaded Content. You acknowledge and agree that you may not sublicense, assign or otherwise transfer this license or the Downloaded Content and that no title to the Downloaded Content has been or will be transferred to you from Blizzard Entertainment® or anyone else. You also agree that you will not alter, disassemble, decompile, reverse engineer or otherwise modify the Downloaded Content.

Also, we reserve the right to revoke this limited use license at any time, for any reason, and at the sole discretion of Blizzard Entertainment®. You may not use our materials on sites that feature defamatory pornographic, or inflammatory content, including, but not limited to, hacks and cheats for any of our games or any other content that Blizzard Entertainment® find objectionable or unlawful.

So, is this "conferm" with the GPL when I add the copyright from Blizzard to the footer?

If Blizzard is copyright holder, you or I cannot relicense the image as "GPL". It cannot be included in the Drupal.org CVS repository.

I'm moving this to webmasters.

So what? Remove? Only the image or the whole theme?

vm’s picture

Queue cleanup:

we need a consensus here. If the images are copyrighted and can't be used commerically. I think the images should be removed. d.o can't determine whether a theme will be used commercially or not.

avpaderno’s picture

The theme without images is useless; it should be removed.

vm’s picture

There are 4 themes actually in question here now I think. WOW logo could likely be seen as an issue too no?

The links for the themes are http://drupal.org/project/wowwotlk, and http://drupal.org/project/wownightelf; there are two further themes that are not mentioned here: http://drupal.org/project/wowgreen, and http://drupal.org/project/wowdarkblue.

My opinion is that these all need to go, as they not only contain Blizzard's World of Warcraft wordmark, but at least some of the images appear to be derived from the wallpapers available at Blizzard's Web site (e.g., http://www.worldofwarcraft.com/wrath/downloads.xml), which are certainly not distributed under a GPL-compatible license. From Blizzard's legal FAQ:

What is Blizzard Entertainment's® copyright / trademark policy for the Internet, specifically for fansites? Can I use Blizzard Entertainment's® images, text or sound on my web page? Is it ok if I use screenshots I take in-game on my web page?

The statement from Blizzard is most definitely not GPL compatible, so the images cannot be included in CVS. They should be removed. That does pretty much render those themes dead, given how image centric they are, so it's probably easier to just remove the themes entirely.

avpaderno’s picture

The themes have been unpublished, no release is visible in the project pages, and the tarball archives have been deleted.

The files in CVS still need to be deleted. Is there a quick way to delete all those files?
