Issue Summary
This theme could be WCAG AA compliant with a minor change. Try it out at http://d-theme.com/light_fantastic. The first heading on the page is the site name in a h2 element, which blows away WCAG AA. The site name could be h1 to start the flow of headings or a formatted division to not interrupt the flow of any other headings.
The ideal would be to have the page heading as the h1 because that identifies the page. Each node and block could start at h2.

It will take a little more than just switching the headings as the site title is set to H1 on the front page and H2 on internal pages so that the actual page title can be a H1 on the internal pages for SEO, and search etc. We should perhaps look at re-structuring the code to put the page content above the navigation which would have other benefits in these areas as well.
