This is because of other elements among the page render result, but not the problem of theme itself.

Some simple procedures for testing theme with XHTML 1.0 Strict:

  1. Flash new Drupal install with latest version.
  2. Download and install devel.module, and enable the dummy data generator.
  3. Download and install the target theme.
  4. Generate some dummy data with devel.
  5. Test this site with XHTML 1.0 Strict.

Remember: As long as production site MAY coming with some custom page elements, it is not easy to judge if theme as XHTML 1.0 Strict or not. This can also apply to case of CSS validation (As Drupal's core CSS file are not absolutely pass, too).
