Activate the the Comment controls under every node (goto admin/comment/configure)
and then go to a node with some comments
and then try to change it to e.g. a flat list and press Save.
The site reloads but nothing happens but if you refresh the site or if you press again save the change appears

We had the same problem with /admin (or to be clearer: with the watchdog log) after we converted to formsapi so I think that this is formsapi bug too

another suggenstion: we could put this "comment viewing options" into a (collapsed) fieldset for consistency, because we use it everywhere
