Taxonomy Terms output even though restricted

Im using the method put forth here: http://drupal.org/node/225426 to display a hierarchical view of content but the problem is that tac doesn't restrict the output of the taxonomy terms even though they should be restricted.

So that view ends up showing terms with no child nodes to users who don't have access to those terms.

Im at a loss on how to keep the taxonomy terms from being display when the user doesn't have access.
