If I pass my site with -l or use a default sites, the DL command always downloads new modules into the drupal root. I'm using the latest HEAD as of 5/2/2009, still doing it. It should default to sites/all/modules if it exists, definitely not the drupal root folder.

Oh, and this happens with DP5 and DP6 sites, haven't test 7 yet.
