actually under Drupal 6.14 the comment upload form does not appear at all, using the ajax comments

It is worth noting that in the readme it says:

NOTE

As comment_upload heavily modifies the way comment form submission works, there
is a chance that it is not compatible with other modules changing the comment form.

Edit - this refers to the readme of comment_upload module.
