Ouch, furthermore you claim in your copyright:

All copyrights on this theme, the code, logo and images are reserved to Vitzo Limited (2008-2009).

You cannot claim copyright over GPL code.

That's a remnant from before the code was committed to Drupal. The current version does not claim copyright over the PHP code.

6.x-1.1 still claims:

You may use this theme, with the exception of the VITZO.COM logo and favicon, and modify it as you please on the condition that you do not alter or remove any of the hyperlinks to www.vitzo.com. All copyrights on this theme, the code, logo and images are reserved to Vitzo Limited (2008-2009).

Also, I don't want to have themes on d.o. that need a copyrighted image pack from somewhere else. This theme should either be contributed in full to d.o. under the GPL, or if you don't want to or are not able to, removed.

Cross-ref: #470086: Theme hosted on Drupal.org shows a blank page because the author removed the files not under GPL license.
