I tried the stable release, where users could go into their settings and set not to receive any notifications. But they would still be presented with the notify comment option, however this wouldn't actually take affect.
If I changed the user setting to receive notifications for all comments then this worked, and I could disable this on a per comment basis.
Then I tried the dev release thinking this might be fixed, however now I don't even get the option to subscribe when their settings is set not to receive any notifications.
It would be great to create an option where by default they don't receive comments, but they can opt-in on a per comment basis.
Hope this all makes sense.

I believe that's how it works, so if you don't experience that there is a problem.
Can you describe your permissions for the user in question and the comment notify settings?

I assume the permissions was the issue.

Sorry I ended up using a different module in the end as I couldn't get it working. No worries.
