Hello,
First of all, thank you for the theme, personally I really like it.
Here's the issue:
I have noticed that menu items in the navigation menu show expanded even when they are selected not to. The problem usually occurs when there are items within items.
For example:
my account
logout
administer
=>site building
==>Menus
===>navigation
=>content management
==>content types
Even when all items are set to not expand, the second layer "navigation" will show for some reason...
weird.

This theme doesn't touch the menus in anyway that could affect that behaviour.... Cannot replicate this.
You must be something else going on. Only if you are on a page that is part of the menu would it's parent show expanded, and that's drupal default behaviour. Check if other modules are doing something there i guess.
